Terms of Service

1. Who we are

ProfitAgentsAI is operated by Macuno Ltd (“Macuno”, “we”, “us”, or “our”), a company registered in England and Wales, trading as ProfitAgentsAI. These Terms of Service (“Terms”) govern your access to and use of the ProfitAgentsAI website, software, and related services (the “Service”).

By purchasing access, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

ProfitAgentsAI is a tool for creating affiliate campaign assets, including review pages, bonus pages, email sequences, graphics, presenter video, and related promotional content generated with AI. The Service is provided for business use by customers who have a valid purchase.

3. Accounts and licence

Access is granted after a valid purchase processed through JVZoo. We create or enable an account using the email address supplied at checkout. You must keep your login details confidential. Accounts are non-transferable and may not be shared, resold, or used to provide the Service to third parties.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own affiliate marketing activities, subject to these Terms and any usage limits (including credits or tokens) associated with your purchase.

4. Your responsibilities

You are solely responsible for:

  • Complying with affiliate programme terms, advertising rules, and applicable law, including ASA (UK) and FTC (US) disclosure requirements where they apply.
  • Reviewing, editing, and fact-checking all AI-generated content before you publish or send it.
  • The offers, claims, links, and products you promote, including whether they are lawful and suitable for your audience.
  • Any website, domain, or account you connect to the Service.
  • Keeping your account secure and notifying us promptly of unauthorised use.

You must not use the Service to generate illegal, deceptive, defamatory, or infringing content, to spam, or to attempt to disrupt or reverse-engineer the platform.

5. AI-generated content

Output from the Service is produced by automated systems and may contain errors, omissions, or unoriginal material. You own the campaign content you create with the Service, subject to any third-party rights in source material you provide and our ownership of the platform, templates, presenters, and software. We do not guarantee that generated content is unique, accurate, or free of third-party claims.

6. No earnings guarantee

Nothing in the Service constitutes a promise of income, traffic, conversions, or any other result. See our Earnings Disclaimer.

7. Fees, credits, and refunds

Fees are charged by JVZoo at the time of purchase according to the offer you select. Credits or other usage entitlements are applied to your account as described at checkout and in the Service. Unused credits have no cash value. Refunds are handled under our Refund Policy.

8. Suspension and termination

We may suspend or terminate your access if you breach these Terms, if a purchase is refunded or charged back, or if we reasonably believe your use risks harm to us, other users, or third parties. You may stop using the Service at any time. Provisions that by their nature should survive (including liability, governing law, and intellectual property) continue after termination.

9. Limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all implied warranties and are not liable for loss of profits, revenue, data, goodwill, or any indirect or consequential loss, or for decisions you make based on generated content.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law. Our total liability arising out of the Service is limited to the amount you paid for the relevant purchase in the 12 months before the claim.

10. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Service after an update constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.
